What is the Homeowners Association (HOA)?
McConnell Homeowners Association, Inc. is composed of all lot owners in the McConnell neighborhood. The specific purposes of the Association are to provide for maintenance, preservation and architectural review of the residence lots and common areas within McConnell. Each lot owner in McConnell has a voice in the operation of the Association. As provided in the Declaration of the Covenants, Conditions and Restrictions (CCRs) each homeowner member of the Association is entitles to cast one vote for each lot owned.

Is membership in the HOA required?
Yes, all lot owners are members of the Association.


Who directs the Homeowners Association?
The lot owners through the elected Board of Directors and officers, direct the operation of the Association.The number of directors is five, and one or more individuals from among the homeowner members may be elected to serve on the Board.


What are the responsibilities of the HOA?
The association is responsible for promoting the health, safety and welfare of residents in the McConnell neighborhood, the enforcement of the Covenants and rules of the Association, and for the improvement and maintenance of properties owned by the Association areas within landscape easements. (Please be aware members of the Association are responsible for enforcement of the Covenants and Restrictions in addition to the Association. Any owner of a lot which appears on the same recorded map as a lot in violation can bring action at law against the owner of the lot in violation to enforce the restrictions.)


Who handles the management of the HOA?
The Association is currently managed by Hawthorne Management Co. At the present time ,questions or comments concerning the Association may be directed to Neale Turlington at 704-377-0114.


When are meetings of the association held?
Annual meetings are held on the fourth Wednesday of January.


What are the obligations to your association?
In order to maintain your community, all members must pay assessments for maintenance costs and other activities of the Association. Information concerning payment of your assessments should have been given to you at closing or sent to you by mail. How are assessments to be paid?
The Board of Directors will set the payment schedule for the upcoming fiscal year by December 1st each year and notice of the dues shall be sent by December 16th each year. Due dates and frequency of payments will be set by the Board of Directors. Payments not received by the delinquency date specified in the documents are subject to interest charges, late fees; further, delinquent association members are subject to legal action for nonpayment of assessments. Annual dues will be collected at closing on a pro-rated basis for buyers who close during the current calendar year.


How is the amount of the assessment determined?
The fiscal year of the Association is the calendar year. Each year before the fiscal year ends, a budget for the association for the new fiscal year is prepared and approved by the Board of Directors with the assistance of a Finance Committees and the Management Company. The budget will set forth the anticipated operating expenses and reserve contributions for the coming year. The total annual amount is then divided by the number of lots in the community to determine the annual payment amount. Any increases in annual assessment greater than 10% must be approved by no less than two-thirds (2/3) of the votes cast by each class of membership.


Can the Association be dissolved?
The Association may be dissolved only upon the signed written assent of three-fourths (3/4) of the votes appurtenant to each class of lot.


What restrictions are applicable to each lot?
Certain restrictions are spelled out within the CCrs in Article VII. These restrictions are designed to protect the investment of each McConnell resident and to further enjoyment within your neighborhood. Copies of all association documents (CCRs, Bylaws, and Articles of Incorporation) are given to you at closing and should be kept in a safe place for future reference.

Before you make changes, additions or modifications to structures or lots you should review the CCrs for McConnell. There are restrictions on types of fencing, pools, satellite dishes, mailboxes, etc. of which all owners should be aware before making any alterations or additions to structures or lots.


Who is responsible for enforcement of restrictions?
Enforcement of restrictions is by action at law by any lot owner of a lot located within the same recorded map as the lot against which the action is to be brought. In the interest of preserving and protecting the values and attractiveness of the community, the enforcement action may also be brought against the lot owner by the McConnell HOA.

Can the HOA Documents be amended?
Yes, with the assent of three-fourths (3/4) of the entire vote of the membership.

Each lot owner should read the documents thoroughly before purchasing a home. These questions and answers are for informative purposes only.
